Staff said the update modernizes terminology, defines a fee-in-lieu for drip-field connections, clarifies active versus inactive capacity (including a 10% nonrefundable deposit for inactive reservations), and shifts routine approval authority from the board to town staff while reserving board review for deviations from the standard agreement. "The creation of the reservation process has been a clear benefit ... but over the course of the past 5 years, staff has identified several elements that are due for updates and revisions," staff said.
Board members asked detailed questions about how active capacity is measured (treatment plant versus disposal capacity), what constitutes progress to avoid automatic expiration, and whether holders must act within a set timeframe. One member said once connected, the owner should move forward within one year. Staff and members agreed to refine definitions and address additional language in the reservation agreement; a resolution amending the standard agreement will accompany the second reading in March.
The first reading passed on a roll-call vote; a second reading and resolution amending the standard agreement will return to the board next month.
