Waupaca County board continues hearing on Holbrook’s request to replace leaking flat roof with pitched truss

The Waupaca County Board of Adjustment on Nov. 14 continued a public hearing on a variance request by homeowner Zachary P. Holbrook to replace an existing flat roof with a pitched truss roof on a dwelling that lies inside the State Road 22 highway right-of-way setback.
The hearing, opened by Chair A. Richardson at 10:34 a.m., focused on a 0.86-acre Rural Residential parcel in the Town of Larrabee (parcel 10-13-31-16). Holbrook testified in person and said the flat roof is leaking and he needs a new truss system. “The existing flat roof leaks and would like to replace with new truss system and pitched roof which I need a variance for project,” Holbrook said.
Planning and Zoning Land Use/Code Enforcement Specialist Candace Bauer presented the staff report, which recommended denial. The report concluded Holbrook had not demonstrated the legal variance criteria: the parcel as a whole can accommodate development without a variance; the property’s location pre-dates setback regulations and economic hardship does not justify relief; and the proposed modification would undermine the ordinance’s purpose to protect highway safety and dimensional standards.
Zoning Clerk Becky Landre read an email from the Wisconsin Department of Transportation indicating DOT had no concerns with the proposal. Board members discussed limiting the pitched roof change to the 17.5-foot portion of the dwelling that falls within the roadway setback and not allowing a matching modification to the garage; Holbrook agreed to move the garage back three feet to meet setback requirements.
After closing testimony, the board voted to CONTINUE the hearing and asked Holbrook to submit revised plans for review at a meeting to be scheduled in mid-to-late January (motion to continue by G. Marx; second by P. Leder; voice vote 5-0). No final variance determination was made.
Next steps: the board will review new plans when they are submitted and reconvene the public hearing at the January meeting. No structural work within the 17.5-foot roadway encroachment was authorized at this session.
