Attorney general testimony cited as House members oppose sweeping pretrial bail changes

On May 5 the Hawaii House of Representatives recorded substantial floor opposition to proposed changes to the state's pretrial bail system after Representative Shimizu read submitted testimony from the Attorney General and other stakeholders.

Shimizu told colleagues she was "not reading my words — just reading from the attorney general" and said the department strongly recommended holding the bill. The AG's written comments, read into the record by Shimizu, said the proposed legislation would impose sweeping changes to chapter 804, HRS, and could remove judicial discretion to consider the "totality of circumstances" when setting bail. The AG warned that removing discretion could increase risks of nonappearance and public-safety threats.

Opponents on the floor also noted the absence of direct input from the judiciary and other affected agencies in the legislative record. Shimizu cited opposition testimony from multiple county prosecutors, the Maui police department and other law-enforcement entities that expressed concern the bill would go too far without supporting data.
