Assemblymember Ward introduced AB 16 84 to the Assembly Housing and Community Development Committee as a measure to ensure homeowners can install, replace or use home cooling systems without obstruction from homeowners associations.
An authors witness described a constituent who faced extensive delays and legal costs to install a mini-split, and argued that access to effective cooling is a public-health and energy-efficiency issue. "No family should be denied access to an air conditioning system that best meets their health, safety, and energy needs," the written statement read.
In opposition, Carlos Gutierrez with the Community Associations Institute warned that the bill, as written, "goes beyond just ensuring that people have access to cooling systems" and could remove reasonable HOA rules that protect common areas, aesthetics, and shared systems. Gutierrez said the current bill language could make enforceable rules void and expose associations to civil penalties; he offered specific amendment suggestions to clarify that reasonable restrictions and architectural review processes remain allowed.
Committee members pressed the author on guardrails, asking whether the bill would preserve local building and health-and-safety standards and how to address drainage, electrical capacity and other potential impacts on common property. The author said the bill does not supersede local ordinances or building standards and that staff will continue to review suggested clarifying language.
The committee moved AB 16 84 forward; members said they expect continued negotiations on language that balances resident access to cooling and protections for shared structures.
