Waupaca County Board of Adjustment elects new chair, approves policy updates and requests DNR opinion on shoreland variances

Planning and Zoning Director Ryan Brown called the Waupaca County Board of Adjustment to order at 9:00 a.m. on April 25, 2022. The board elected A. Richardson as chair following the resignation of former Chair P. Craig, approved updates to its policies and voted to request the Department of Natural Resources' (DNR) opinion on shoreland zoning variance requests.
The board moved quickly through routine business. A. Richardson moved to approve the meeting agenda, which passed; later, G. Marx moved and J. Fulcher seconded approval of the March 31, 2022 meeting minutes, which the board adopted.
Director Ryan Brown told the board that the Board of Adjustment policies were last updated on June 1, 2006 and opened a review of possible revisions. Board discussion identified several specific proposed changes: require plans be drawn by a licensed land surveyor (Section 2(b)); remove Section 8 so County Corporation Counsel would not be required to attend hearings; add an organizational meeting with officer elections every two years following spring elections; and limit the number of County Board Supervisors serving on the Board of Adjustment to two. Members also discussed making a formal request to the Department of Natural Resources for an opinion on shoreland variance requests, consistent with a DNR suggestion that county BOAs make such requests.
P. Leder moved and G. Marx seconded a motion to request the DNRopinion on shoreland zoning variance requests; the motion carried. Vice-Chair D. Johnson then moved, with P. Leder seconding, to update the policies as discussed; the motion carried. Staff will prepare a draft version of the updated policies for the board to review at the next meeting before final approval.
Land Use/Code Enforcement Specialist Candace Bauer told the board about a Center for Land Use Education webinar titled "Role of the Zoning Board of Adjustment/Appeals and Variances" scheduled for May 5, 2022 from noon to 1 p.m. Board members agreed it would be useful to attend the training together; staff will reserve a room. There was also preliminary discussion of Waupaca County hosting a regional Board of Adjustment training.
Bauer said staff had received one complete variance application and another application that required a corrected survey; staff are working with that applicant to obtain a compliant survey. She also said discussions about possible administrative appeals have occurred but no formal appeals have been filed.
The board adjourned at 9:58 a.m. after J. Fulcher moved and G. Marx seconded the motion to adjourn. Respectfully submitted minutes were signed by Candace Bauer, Land Use/Code Enforcement Specialist.
