Staff recommend lien settlement for YBD 3 Lakes Plaza ahead of commission meeting

City building staff on Jan. 26 recommended the commission accept a proposed settlement to resolve multiple city liens on YBD 3 Lakes Plaza, staff said at a staff agenda review workshop.
Tony Palacios, building official, told staff the property has a lengthy enforcement history under TR14022, noting there were 33 liens at one point — 21 from building and 12 from code enforcement — and that outstanding fines were discussed in the earlier commission review. "The proposed settlement is the $100,000 that they submitted originally," Palacios said, describing the owner’s offer and the release-of-liens fee staff expects to include in a stipulated agreement.
Palacios and other staff summarized the property’s status: several permits remain open, including façade and roofing permits, and staff said the property is now largely back in compliance with three active liens, five open permits and one pending special magistrate case. A staff member said the owner initially proposed a separate $100,000 beautification commitment and later mentioned total beautification work of about $1,000,000.
Commissioners pressed staff for more detail about the owner’s planned investment and permit values, saying the settlement appears contingent on the promised improvements. "I thought when we had the meeting, the property owner talked about in excess of 1,000,000 or 2,000,000 in improvements," the Moderator said, asking staff to obtain a final budget from the owner before the Jan. 29 commission meeting.
Staff did not record a formal vote at the workshop; the recommendation will be presented to the full city commission for consideration on Thursday. The staff report and the owner’s final cost estimates and permit documentation are expected to be included in the commission packet.
