Kevin Baxter, the elected Erie County prosecuting attorney, testified in support of House Bill 696, saying the bill clarifies prosecutorial jurisdiction in municipal courts across Erie County.
Baxter described the county's municipal courts and noted historical legislation converting Erie County Court to Erie County Municipal Court in 2005, which took effect in 2008. He said HB 696 is consistent with historical practice by providing uniform prosecutorial responsibility across municipal courts and noted the county prosecutor already handles prosecutions in most municipal-court territories by contract. The committee asked a series of clarifying questions and was told there are written submissions from local law directors; the committee concluded the second hearing for HB 696.
