The McLendon-Chisholm City Council unanimously approved an ordinance to add Article 10.04 to chapter 10 of the code of ordinances to clarify how subdivision plats and infrastructure improvements in the city's extraterritorial jurisdiction (ETJ) will be administered and reviewed.
Fabrice (city staff) said the change relies on the city's authority under Texas Local Government Code chapter 212 to regulate subdivision activity in the ETJ and that the amendment organizes and clarifies existing standards so they are applied consistently. "This ordinance provides clarity, predictability and legal reinforcement regarding the city's subdivision authority in the ETJ," Fabrice said.
Council Member London emphasized what the ordinance does not do: "It does not regulate zoning or land use in the ETJ. It does not change density. It does not prohibit development," London said, adding the amendment preserves ministerial, objective review and ensures the same engineering and infrastructure standards apply to ETJ developments as those inside city limits.
Staff recommended approval. The council moved, seconded and approved the ordinance by a show of hands (unanimous). The ordinance also clarifies that any modification of subdivision standards proposed through development agreements must be specifically identified and approved in a duly posted public meeting.
