Heard County denies rezoning after applicant fails to appear; adopts PTSD resolution, postpones planning appointments

Heard County commissioners on Feb. 18 unanimously denied a rezoning application after the applicant failed to appear at a scheduled public hearing, postponed three Planning Commission appointment items for readvertisement, and adopted a First Responder PTSD Program resolution.
The meeting, held at the Heard County Administration Building, opened at 6:30 p.m. with Chairman Tracy McCormick presiding. County Attorney Michael Hill told the board that the county ordinance provides that "failure of an applicant or his/her representative to be present for the hearing shall result in automatic termination of any proceeding on the amendment and a negative recommendation on the proposed amendment by the Chairperson and Commission of the County." The applicant, Jane Adams, did not appear and there were no public comments in support; on a motion by Commissioner James Perry with a second from Commissioner Iris Harris, the board voted unanimously to close the public hearing and later voted, again on a Perry motion seconded by Harris, to deny the rezoning application for failure to appear.
The board approved minutes from its Jan. 21 work session and regular meeting on a motion by Commissioner Iris Harris, seconded by Commissioner David Walls, and then voted to postpone and readvertise all Planning Commission appointment items after Commissioner Larry Hammond moved and Commissioner Walls seconded the motion; the postponement applied to three separate appointment agenda items.
Commissioner David Walls moved and Commissioner Larry Hammond seconded a motion to adopt a resolution authorizing a First Responder PTSD Program and to authorize the chairman to sign the resolution; the motion passed unanimously. Chairman McCormick later requested an executive session to discuss litigation. The board entered executive session on a unanimous motion, returned to open session after discussing litigation, and adjourned at 7:40 p.m.
All recorded motions at the meeting passed unanimously. District 1 remains vacant. County Attorney Michael Hill and County Clerk Pretina Billingoley were listed in attendance; the minutes show no public testimony in favor of the rezoning application because the applicant and no representative were present.
