Deming Planning Commission approves alternate subdivision at 1500 8th Street

The Deming Planning and Zoning Commission voted unanimously Dec. 15 to approve an alternate subdivision request by Juan and Olivina Ortiz for the property at 1500 8th Street, allowing the owners to split the large lot. Commissioners Steve Fox, Diego Alvarado Rios, Karen Lively and Alan Briley recorded AYE votes on the motion, which Commissioner Fox moved and Commissioner Lively seconded.
Windia Cassy, planning staff, presented the application to the commission and reported there were no objections to the request. The applicants told the commission they wanted to divide the parcel because the lot is large and they plan to either rent or sell the newly created parcel; they also indicated they may build on the southern parcel in the future. Public Works Director David McSherry told the commission that the Department of Transportation already holds the existing driveway permits for the property.
Recording Secretary Mary Corral noted when the commission asked about posting notice signs at the site that, "I am not aware of that practice in Deming." Commissioners asked procedural questions about driveway permits and future construction before taking the motion to approve.
The commission's decision will become effective after the written order is executed and filed with the municipal and county clerks. The hearing record notes that, pursuant to NMSA, 1978 39-3-1.1.C, any aggrieved person, any member of the City Council, or the City Administrator may appeal the commission's order to the District Court within 30 calendar days of filing.
