Appleton committee denies operator license, restricts amusement‑device approvals and updates special events fees

Mechanical amusement devices — Mad Elephant: City legal and enforcement staff reviewed machines demonstrated at Mad Elephant and concluded they functioned as games of chance. The memorandum noted uncertainty about whether points or credits would be redeemable for anything of value; staff said they had not received written assurances from applicants about the assignment of value. The committee moved and voted to deny the Mad Elephant mechanical amusement device application 5‑0.
Houdini’s Escape Gastropub: For the related application from Houdini’s Escape Gastropub (agent Caitlin James), the committee initially moved to deny but then approved an amendment to accept only two specific titles — a Golden Tee golf video game and an Arachnid electronic dart game — and denied the remainder. The amendment and motion as amended passed by voice vote, 5‑0; attorney Berwin said approvals should be conditioned on assurances that any assigned value for points falls within the limited exception (for example, free replays).
Special Events Policy and other licenses: Clerk Malander and staff described fee schedule updates tied to city service costs and an administrative change to allow limited early facility reservations to accommodate the reservation system. The committee voted 5‑0 to approve the Special Events Policy revisions. The committee also approved a beer license application (205‑1435), a second‑hand article broker license (205‑1434), and a cigarette/tobacco/vaping license (205‑1436) by voice vote, 5‑0.
Committee members said they were uncomfortable approving mechanical amusement devices without written assurances from applicants about point redemption and value assignment and indicated applicants may reapply with the requested documentation; staff noted municipal enforcement and renewal cycles provide additional oversight if machines are later placed into operation.
