City Engineer John Dostart explained the request and said state law requires a public hearing before a private easement can be granted; the city must also receive fair market value for the permanent easement unless property rights are provided to a public agency. For this agreement the proposed compensation was $992 for 600 square feet.
No members of the public came forward at the hearing. The council approved the easement by roll call (Boka, Duer, Evans, Mertz and Stewart voting yes).
