The Lexington County Board of Zoning Appeals approved a variance allowing an existing concrete slab at 112 Durango Drive to remain approximately three feet outside the county’s 30‑foot right‑of‑way setback.
Zoning administrator Walt McPherson explained staff reviewed survey and aerial photographs showing the slab placed slightly outside the required setback. He said the deviation was self‑reported by the applicant and described it as a field staking error during construction.
McPherson noted the county previously increased the right‑of‑way setback from 10 to 30 feet and that correcting the slab would require removing and replacing concrete at substantial cost. Staff characterized the condition as unique to the property and not generally applicable to nearby parcels.
A board member moved to approve the variance after discussion; a second was given and a roll‑call vote recorded each member voting in favor. The motion passed.
The board concluded the misplacement was a site‑specific oversight rather than a broader zoning noncompliance and authorized the variance. Staff will issue the formal approval and retain records and survey evidence.
