The council voted to table a proposed final release of the subdivision maintenance bond for Green Farm Estates (also known as Minglewood) after lengthy questioning about an "odd" communication history between the developer and town staff.
Planning staff told the council the planning commission and the town engineer observed two minor outstanding items (a bolt on a trash rack and sediment in a basin) had been corrected and recommended final bond release. But multiple council members pressed staff on when the work was completed, who performed it and why the developer did not request or pursue the bond release. "Why did anyone go out there?" one councilor asked; another said he had trouble believing the work was fixed by chance observation and raised concerns about recurrent settlement and HOA responsibilities.
Staff said the town engineer inspected the site as part of routine fieldwork and found the items corrected; the planning director described a year-and-a-half-long lapse in communication with the applicant and said the technical review showed the issues resolved. Council members asked whether the town was creating potential future liability for neighbors or for HOAs and whether the timing of the inspection and the absence of applicant-initiated follow-up were sufficient evidence for final release.
Councilman Hall moved to table the release to gather more information; the motion carried and council asked staff to place the item on an executive-session agenda for further discussion and to provide additional documentation on the repairs and HOA responsibilities before reconsideration.
What this means: the bond remains held by the town while staff will return with clarifying details about who performed the repairs, exact inspection dates, and the HOA's operation and maintenance obligations.
