Opponents — including restoration professionals, county stormwater officials, and engineering associations — warned HB 14-65 would add prohibitive costs and administrative hurdles, effectively limiting an MDE‑endorsed tool they say is needed to stabilize eroding channels, remove high‑hazard dams, and meet MS4 permit obligations. Rory Murray (Chesapeake Watershed Restoration Professionals / American Council of Engineering Companies) noted that modern projects are already subject to layered federal, state, and local approvals and post‑construction monitoring under recent statutes.
County and municipal officials gave mixed testimony: Frederick County cited projects that removed a high‑hazard dam and restored connectivity for migratory fish, while opponents emphasized that upstream stormwater controls alone cannot always address degraded stream channels and that monitoring and stewardship costs are significant but already part of project planning.
Committee members asked technical questions about how credits are calculated (based on Chesapeake Bay Program formulas and soil sampling) and whether out‑of‑stream alternatives can scale to achieve required pollutant reductions. Proponents insisted credits should be tied to measured ecological outcomes rather than construction completion; opponents said current frameworks (including the Whole Watershed Act and existing guidance) provide guardrails and that additional restrictions could impede necessary work.
