Committee upholds appeal, recommends operator license for David White

The Public Works and Protection Committee voted March 3, 2026, to uphold an appeal by David White and recommended that the village board issue him an alcohol operator license.

Staff member Joel told the committee that White's file includes recently issued municipal citations for possession and drug paraphernalia that are pending, and said those citations are not felony or misdemeanor convictions. "It is recommended by staff that the committee grant the appeal and issue the operator license because of the nature of the charges, both being civil, and the fact that there is not an active conviction on those records," Joel said.

Joel cited the committee's interpretation of applicable state law and counsel's advice, saying the municipal citations do not provide a statutory basis to deny the license under the cited state statute. Committee members asked how a later conviction would affect the license; Joel said revocation would be pursued only if convictions meeting revocation standards occur and that such a process would require a quasi-judicial hearing.

A committee member moved to uphold the appeal "based on the recommendation of our counsel," and the motion was seconded. The committee voted in favor and the motion carried; the committee directed staff to forward the recommendation to the village board for final action.
