LAFCO narrows public‑member reappointment process; commission approves option for two reappointments

The San Mateo Local Agency Formation Commission voted to adopt a revised procedure that permits the commission to reappoint an incumbent public member or alternate without an open recruitment process for up to two reappointments, provided the reappointment is placed on a publicly noticed hearing at least 21 days in advance and the staff report documents the incumbent’s meeting attendance and participation.

Rob Bartoli and legislative committee members described the change as an option the commission can use to retain institutional knowledge while still requiring public notice and placing a maximum of two reappointments before an open recruitment is required. Commissioner Rinaldi, who served on the legislative committee that reviewed the change, said the committee added language to ensure transparency and to prevent indefinite entrenchment. "We really want to maintain the public's trust," Rinaldi said.

One Zoom speaker, Sid Young of Moss Beach, urged the commission to avoid a process that could lead to repeated reappointments without public participation. Commissioners discussed practices at other LAFCOs; staff said several LAFCOs have similar policies and that open recruitment remains an option any time the commission chooses it.

The commission approved the proposed policy by motion (moved by Commissioner Rinaldi, seconded by Commissioner Martin) with one member voting no. The motion carried and the revised procedure will permit, at the commission's discretion, up to two successive reappointments of an incumbent public member before an open recruitment is required.
