Commission approves seasonal garden center permit at Classic Lanes parking lot

The Oak Creek Plan Commission approved a temporary use permit that will allow a seasonal garden center to operate in the south portion of the Classic Lanes parking lot at 7501 South Howell Avenue from April 15 through July 15, with removal of equipment by July 17.

Staff described the request as the applicant’s 17th consecutive year seeking the permit and said there have been no recorded complaints in prior years. The application specifies hours of operation Monday–Friday 9 a.m.–6 p.m., Saturday to 5 p.m. (a one‑hour Saturday extension was included in past conditions), and Sunday 9 a.m.–4 p.m. The permit limits signage to one 32‑square‑foot sign and one 12‑square‑foot sign; Classic Lanes agreed to provide water and restroom access for the seasonal operation.

Commissioners asked staff to monitor a patch of grass shown in older photos that appears to have tire/vehicle encroachment. One commissioner said the damage might predate the applicant’s use and cautioned against placing repair responsibility on the seasonal operator if it cannot be tied to them. Staff noted the photos in the packet are from 2019 and recommended noting the issue but not making repair a condition unless responsibility is established.

A commissioner moved to approve the temporary use permit with standard conditions: compliance with code, location within the mapped portion of the lot, the stated hours, signage limits and setbacks, required tent permit, and the April 15–July 15 permit period with site restoration by July 17. The motion passed and commissioners offered seasonal well wishes to the operator.

The decision is final at the commission level; the permit holder must obtain required permits before operation and must restore any damage documented at site close-out.
