County launches dispute-resolution process after Wellington annexes Artistry Lakes parcel

The Palm Beach County Commission voted unanimously to start the statutory dispute-resolution process after Wellington enacted an ordinance annexing the Artistry Lakes parcel.

County attorney Darren Leiser told the board the county seeks to protect negotiation leverage on key public needs — notably right-of-way for a future Okeechobee Boulevard extension, a civic parcel intended for a fire station and workforce-housing commitments tied to the development. "Our argument would be that this property is undeveloped and does not meet the statutory requirements for annexation," Leiser said as part of the legal rationale the county would advance if talks stall.

Wellington’s village attorney, Laurie Cohen, urged patience and said Wellington is already negotiating with the county on an interlocal service boundary agreement; she suggested the county could abey the Chapter 164 process while staff-level negotiations continue. Developers and representatives for the subject property, including Ken Toomey for Colter Homes, said the property owner consented to annexation and that right-of-way and a civic parcel dedication are already being discussed.

County staff noted a 30-day statutory window (triggered when Wellington adopted the ordinance) to begin the dispute-resolution process; staff recommended initiating the Chapter 164 path to preserve the county's place in line while continuing negotiations. Commissioner Weiss moved to start the dispute-resolution process; Commissioner Sachs seconded and the motion carried 7-0.
