Council moves Special Use Permit appeal hearing to Sept. 22 after appellant requests change; applicant sought dismissal

Mayor Tim Fletcher and the City Council on Aug. 25 voted to move Appellant Dave Ferguson’s closed-record appeal of a Planning Commission decision on a Special Use Permit from Sept. 8 to Sept. 22, 2025.
Special Legal Counsel Charlotte Archer provided legal context for the council’s consideration after Mayor Fletcher introduced her and noted she was participating via Zoom. Meridee Pabst, representing applicant Vertical Bridge, told the Council that Vertical Bridge was asking it to dismiss the appeal because the filing was late. "Vertical Bridge is asking Council to dismiss the appeal due to a late filing," Pabst said.
Ferguson joined the meeting by Zoom and explained his request to change the date. After discussion and counsel input, Council Member Soha moved to move the hearing, Gingell seconded, and the motion carried.
Attorney/Planner Fleck also read Ferguson’s appeal into the official record and confirmed that the matter will be heard by the Council on Sept. 22, 2025. Mayor Fletcher invited the parties either to appear or be represented at that hearing; no dismissal was recorded on Aug. 25.
The Council’s action was procedural: it changed the hearing date and preserved the matter for adjudication on Sept. 22. The transmittal and scheduling were the most recent formal steps; the Council did not take a final position on the merits of the Special Use Permit or the timeliness objection. The upcoming closed-record hearing will be the opportunity for the Council to resolve the appeal.
