Director reports split council vote leaves planning commission decision intact; Tennessee Village approved by council

DeSapnik said the Nov. 19 council vote on a Tennessee warehouse matter was split after the mayor recused himself; because the council vote produced no majority, DeSapnik said there was no council action and the Planning Commission decision (from March/April) remains in effect. He also told commissioners the council on Dec. 3 approved the Tennessee Village project, which had come before the commission earlier and now is expected to move forward.
Commissioners asked about timing and re‑application windows for applicants whose projects were not approved by the council; DeSapnik said the code does not require a substantially different resubmittal and that an applicant generally must wait six months from the Planning Commission decision before reapplying. He said outside counsel has been retained by the City Attorney's Office to research issues related to the warehouse item and that staff will report back when that research is complete. DeSapnik did not provide a specific timetable for the outside‑counsel work.
The commission had no further action on those items at the meeting; the director said he would report back when additional information from the City Attorney's Office is available.
