Redlands reports initiation of two litigations; council notes recusal on related item

The City of Redlands reported on Sept. 3 that, following a closed session, the council had voted to initiate litigation in two matters and held conference with legal counsel on multiple cases. Albert Maldonado, special counsel with Best Best & Krieger, gave the closed-session report in open session.
Maldonado said the council had discussed initiation of litigation under Government Code section 54956.9(d)(4) and conferencing with legal counsel under section 54956.9(d)(1). He named Coyote Aviation Corporation v. City of Redlands and two related matters identified as Gada et al. v. City of Redlands as among items reviewed. "The council voted to initiate litigation in two different cases," Maldonado stated, and noted that details of defendants and other particulars will be disclosed once filings are formally commenced and become public record at the city clerk's office.
Maldonado reported motions were made and seconded—by the Mayor Pro Tem and by Councilmember Salcedo in the two items reported—and each motion passed by affirmative unanimous vote. He also said that on one of the Gada items Councilmember Davis recused himself because he owns property within 500 feet of the matter under discussion.
The mayor announced the council would remain in recess and reconvene later for the open session. Maldonado and city staff said the clerk’s office will provide records about the initiated matters once cases are formally filed.
