Committee lands on time-limited tobacco/vape exemption for one North Beach store; sponsor to draft language

The committee considered a narrow amendment to the land development regulations to allow a limited distance-separation exemption for tobacco and vape sales to address a small-business hardship in North Beach.

Staff explained prior research found no evidence that tobacco and vape were previously permitted at the subject location and that adjacent stores with historic licenses were grandfathered under earlier rules. Mohammed Islam, the owner seeking relief, said cigarette sales are a primary item that allows his convenience store to survive. Commissioners expressed sympathy for the owner and concern about creating precedents that could allow proliferation of tobacco outlets in commercial overlays.

Committee members discussed options including a voluntary covenant/sunset provision that would permit sales for a defined period and then require discontinuation. After debate, the committee agreed on recommending a three-year sunset provision (after which the use would be legal nonconforming or discontinued by covenant) and to send a 'no recommendation' to full commission so the sponsor can refine language. A prior Planning Board hearing had transmitted an unfavorable recommendation (7–0), but several commissioners signaled appetite to craft a narrowly tailored remedy for the specific site.

Next steps: Commissioner Dominguez (sponsor) will work with the city attorney and planning staff to draft amendment language that incorporates a three-year sunset and covenant provisions for Commission consideration.
