The Board of Zoning Appeals on Wednesday approved a variance reducing the rear setback to 10 feet for a proposed second residence at 2416 24th Avenue North.
Owner Mark Mohammed told the board the alley access is narrow and the internal turning radius is tight; he said about 10 feet of the property overlaps the main road and there is effectively no street parking near the house. Mohammed described those site conditions as hardships that led him to request the variance.
Board members debated the extent of the hardship and whether the proposed building envelope could be reduced. One member said rear setbacks are sometimes more flexible than front or side setbacks when separation or an alley exists, and a motion was made and seconded to grant a 10-foot rear setback based on the hardships described.
After the motion passed, the chair announced the approval and the applicant was told to coordinate with codes staff for permitting. The board’s stated basis for approval: alley accessibility limitations, street paving encroaching into the front yard and demonstrated site constraints.
