Downtown business owner asks city for written guidance on mobile vendor rules

Pearl Warner, owner of Tomball Social House (209 Fannin Street), asked the council for written guidance on how the city's mobile food vendor ordinance applies to a single vendor that operates from her private driveway and primarily serves customers of her establishment.
Warner said the vendor operates under its own LLC and point-of-sale and that the arrangement is meant to support her business rather than create a roaming vendor or vendor park. She said Harris County health has approved the vendor's health permit and asked the city to consider whether the use should be treated as an accessory use to the principal business under chapter 50 of the zoning ordinance rather than under chapter 32 for roaming vendors.
"We are not trying to create a vendor park or bring multiple vendors. Our goal is simply to ensure that our guests visiting our establishment in Old Town Entertainment District have access to food while they're enjoying the area," Warner said, asking for a formal written determination so the business can remain in compliance.
The mayor noted the speaker's time expired and thanked Warner. Council did not take questions during the public-comments period; staff later said written requests had been submitted and that city staff would follow up on permit acceptance and written determination.
