Public commenters urge Mesquite to halt Mesquite Vistas annexations amid pending litigation

Public commenters urged the City of Mesquite on Tuesday to pause all Mesquite Vistas annexations and subdivisions until ongoing court cases are resolved and requested the city turn over related documents before any presentations.

"Today, I stand here and ask you to table all Mesquite Vistas, annexations and subdivisions until the courts resolve the litigation between Mesquite Vistas Master Association versus Nordic Beach," said Raylene Giovano, who identified herself as director of North Beach Properties during opening public comment. Giovano told the council she and other association members are involved in litigation and said city action now risks "entangling the city in disputes about subdivisions and annexations that remain unsettled in the courts."

Giovano cited governing documents she said list an "initial property" in Exhibit A and an "expandable area" in Exhibit B, and said those exhibits do not include certain parcels now the subject of annexation. She said amending the association's governing documents requires a 67% vote of members — and possibly approval by mortgage holders — and added that a land surveyor testified under oath in a deposition that some annexation work had not been done correctly. "We need to slow down," Giovano said, asking the council to withhold further annexations and subdivisions "until these final maps are figured out and disclosed by the city to us."

At the meeting's final public comment period the same transcripted speaker gave a second statement under a slightly different self‑identification, saying, "For the record, my name is Raline Chifano," and asking the city to provide documents they said had been subpoenaed and requested from the city clerk before any staff presentation by "Mr. Kim." The speaker said the city had blocked requests for meetings and described the lack of document disclosure as "really looking retaliatory." Staff responded that some documents were ready and others were still under review and that staff would work to provide them.

Why it matters: Annexations and subdivisions can change property governance and tax/service responsibilities and may affect lot ownership and mortgage obligations. Petitioners told the council they fear the city could approve changes now that later are reversed or challenged by courts, potentially creating financial liability for new homeowners.

The meeting record shows no council action to halt annexations; instead, public concerns were entered on the record and staff said they would follow up on document requests. The council adjourned after the final comments.
