Attorney Leon argued that the buyer purchased the property as a duplex and that public listings, tax records and internal evidence (two electric meters, separate entrances and two kitchens) demonstrated ongoing duplex use. “Our request is simply to keep things status quo and to allow my client to essentially legalize a property that’s been used as a duplex,” counsel told the board.
Owner Juan David Torres Lopez said he purchased the building understanding it was a duplex, produced photographs showing two labeled mailboxes, two meters and interior kitchens, and provided an estimate for renovations (painting, flooring, cabinet replacement). He told the board he planned to renovate and seek new tenants after the improvements were completed.
Municipal staff confirmed the borough had not received a renewed rental license for the property since 2021 but indicated a license existed as early as 2014. Board members and counsel agreed that, given the evidence and the applicant’s willingness to make improvements, the appropriate remedy was conditional approval rather than denial.
The board approved the application with two conditions: the applicant must pay back rental license fees due to the municipality and complete the improvements outlined in the application packet before re‑licensing or occupancy. The motion carried by voice vote (board recorded as 5‑0).
