Council approves condominium-suite common-interest plats for Cadler Avenue development

Dan, city planning staff, told the council that developer Boyd Delansky requested two common-interest community (CIC) plats to enable sale of individual units within a 14-building development at 70th Street and Cadler Avenue.
Dan said the underlying use and number of units in the development are not changing; the CIC plat process governs how individual ownership within a building is recorded and includes recorded declarations addressing utilities and access that the city reviews before recording.
Councilmember Ryan moved to adopt two resolutions approving CIC plat numbers 171 and 172 (recorded as resolutions 2026-26 and 2026-27); the motions were seconded and carried by voice vote. Dan said the items were expedited because the developers had their documents in order and were proceeding with unit sales.
Council discussed, briefly, the difference between creating an owners' association after the fact and the CIC plat process, and Dan explained the distinction concerns ownership of space within a building rather than ownership of the building itself.
The council did not ask for additional analysis before voting and approved both resolutions during the meeting.
