Planning staff recommends reapproval of Shadow Creek Estates preliminary plat; commission forwards recommendation

Planning staff told the Planning & Zoning Commission that the preliminary plat for Shadow Creek Estates remains compliant with the city's zoning regulations and recommended that the commission forward a reapproval so the developer may proceed with phase 3.
The staff briefing noted the original preliminary plat was approved in 2020, phases 1 and 2 of the single-family portion were final-platted and built in 2021, and that preliminary plats have a two-year lifespan under the city code unless additional activity extends them. "The prelim plat that was approved at that time is still compliant with our zoning regulations," staff said, explaining the request is essentially a reapproval so construction may advance.
Brian Atwood, representing Signature Companies and the applicant team, said the company supports the staff recommendation and that the applicant is "looking to do our next phases out there" and is available to answer questions.
With no further deliberation, a commissioner moved and a second was offered; the clerk called roll and commissioners recorded unanimous "aye" votes. The commission's action was a recommendation to the board of adjustment/city council to reapprove the preliminary plat so the developer may move forward with phase 3.
The staff report cited an existing PUD overlay and said the portion at issue is the single-family section outside the previously final-platted townhome area. Staff also noted that the original preliminary plat and supporting materials remain essentially the same as the 2020 submission and that prior final plats extended the preliminary-plat life into 2023 before the current request was filed.
The commission did not receive substantive neighborhood correspondence by the meeting time; staff said public notice letters were sent out late the prior week and that public comment for the board of adjustment will be germane at that later proceeding. The commission's recommendation does not itself finalize any plat; final platting and any board-of-adjustment or council approvals required for subdivisions will be processed through the city's formal review steps.
