Garden City council approves resolution allowing mayor to license city logos under public-purpose limits

The Garden City Council voted to approve Resolution 1241-26 authorizing the mayor to enter agreements to share and license the city’s logos — including the standard Garden City mark and a bicentennial/250th commemorative mark — provided use serves a public purpose and complies with quality and indemnity terms.

Council legal counsel Wadhams cautioned that use of any logo must have a public purpose and that intellectual property issues may apply when other entities (notably the state) are involved. "The legal standard is there has to be a public purpose," Wadhams said, noting some logos may require state permission and that the licensing agreement should include quality control and indemnification clauses.

Mayor William Jacobs and council members discussed allowing broader local use of the 250th commemorative mark for a one-year celebration while keeping tighter controls on the official city logo to avoid implied endorsements (for example, on commercial or political materials). Council members also raised concerns about brand dilution and specific event contexts — including events involving alcohol or potentially controversial programming — and asked that the agreement allow the city to revoke permission.

Council member Robinson moved to approve Resolution 1241-26; the motion was seconded and passed on roll call (Council members Rasmussen, Carver Herbert, Jorgensen and Page recorded 'Yes'). The mayor and counsel said the city attorney has drafted a one-page standard licensing agreement template that will include scope, quality control, indemnification and termination language.

The resolution delegates licensing authority to the mayor with the expectation that the mayor act within the public-purpose standard and consult with counsel as needed.
