Planning Commission backs ordinance to add cannabis conditional use permits

The Ceres Planning Commission voted to recommend that the City Council adopt an ordinance creating cannabis conditional use permits and related zoning changes, after a staff presentation and brief public comment.

City Attorney Julian told commissioners the proposal is part of a three-step update to the city's cannabis rules: adding conditional use permits (CUPs) for cannabis operations, setting a cannabis business tax rate, and updating the pilot program. The CUPs would be added to the municipal code and would work alongside development agreements and a ministerial city business license, Julian said.

Julian said the CUP application would follow the standard conditional-use procedure and use information from the city's cannabis business program, including background checks and indemnification agreements, and that the planning commission would serve as the approval authority for CUPs.

On operating requirements, Julian said permits would include basic conditions such as maintaining state and local licenses, complying with state law, and paying taxes. For enforcement, the ordinance would allow administrative citations (Julian gave examples of fines of $500 or $1,000), suspension under development agreements and, as a last resort, revocation of permits.

During public comment, John Warren (identifying himself as from the City of Sirius) urged the commission not to allow dispensaries in planned-community areas that include residential housing, asked that dispensaries be kept away from schools and churches, and recommended extending surveillance-recording retention beyond the 90-day minimum. "I would recommend that the length of retention on those be the same thing as a statute of limitations for any crime," Warren said, adding that cannabis operators in the area owe the city "well over $1,000,000" in uncollected fees.

Julian responded that 90 days is the state-law minimum for surveillance retention and that the commission may choose to extend that requirement. He also said state law establishes distance limitations — he cited roughly 600 feet from residences and about 1,000 feet from schools and other places where children congregate — and confirmed the city's two existing cannabis businesses are located in industrial areas and meet current requirements. Julian noted that existing operations would be treated as prior nonconforming (grandfathered) uses.

After discussion, the commission made and seconded a motion to approve the recommendation for the ordinance. A roll-call vote recorded ayes from Commissioner Global, Commissioner Morales, Commissioner Perez and Chairperson Condit; the motion carried.
