The Desert Hot Springs City Council on July 1 approved a cost‑recovery fee of $762.92 per hearing for appeals of denied lost cultivation crop waiver requests and moved forward the corresponding municipal code amendment for a second reading in September.
Planning staff presented a fee study that considered contracted hearing officer rates and staff time and concluded the full cost per hearing is $762.92. Staff said the city has received two waiver applications and held one formal hearing since the provision was introduced in April 2024.
After a brief public hearing with no speakers, Councilmember [motion maker recorded] moved to adopt the fee and to proceed with a code amendment to section 3.38.0.05 of the Desert Hot Springs Municipal Code; councilmembers voted unanimously. City staff said the ordinance will return in September for a second reading and adoption.
The change aligns the appeals process with other city hearing fees and is intended to recover administrative costs associated with formal hearings.
