Montclair staff expect draft marijuana ordinance by month’s end, plan to avoid CEQA where possible

City staff told the Montclair City Council the city expects to receive a draft ordinance regulating marijuana businesses by the end of the month, and that the ordinance will likely be brief to reduce the risk of triggering a California Environmental Quality Act review.
"We believe that we will have a draft ordinance hopefully by the end of this month," City Manager Star said when asked about timing. Star said staff and consultants have been meeting regularly and that the draft could be as short as 30 pages or under 50 pages to help pursue a CEQA exemption, noting that a full CEQA process could add both time and cost "which could be a couple of $100,000."
Staff said they will review the consultants' draft with city legal counsel before bringing it to Council. No final policy was adopted during the special meeting; staff indicated they expect to return with the draft ordinance for Council consideration and potential next steps.
