Council denies request to expand transient rental overlay at 62 West 300 South

After a public hearing on May 20, the Midway City Council voted to deny Ordinance 2025-12, which would have expanded the Transient Rental Overlay District (TROD) to include 62 West 300 South (R-1-22).
Planning Director Michael Henke presented staff analysis and noted the Planning Commission recommended denial. Applicant Jason Powers said he wanted to retain ties to Midway and rent the house part-time; his wife, Malinda Powers, said she was a licensed property manager and would comply with city rules. Neighbor Bonnie McNair said living between nightly rentals had created noise, parking and garbage problems and urged denial.
Council members cited the General Plan’s discouragement of TROD expansion because of potential reductions in full-time housing stock and changes to community character. The motion to deny carried with Council Members Orme, Payne, Simons and Simonsen voting in favor; Council Member Drury was excused.
