The Board of Adjustments approved special exceptions that allow existing and proposed structures at 401 South Trinity Street to encroach into required setbacks, the board said at a meeting where the matter was the primary agenda item.
Lisa Hannon, the planning director, told the board the property has frontage on South Trinity, East Ward and South Market streets and that an existing covered front porch currently encroaches 7.1 feet into the 25-foot front-yard setback. She said a shed encroaches 3 feet into the side yard and 6.5 feet into the rear yard along Market Street, and that the owners propose a new garage that would encroach 5 feet into the required 10-foot rear-yard setback.
"We recommend approval of the Board of Adjustment case BOA-25-0012 with the condition that the property is platted prior to the submittal of building permits and before the special exception is recorded," Hannon said. She told the panel the planning office notified 26 neighboring property owners and did not receive any responses.
During questions from board members, Hannon said the city will require a location survey after the garage foundation is in to confirm the structure falls within the approved setbacks. She also confirmed the proposed garage would be accessed from South Trinity Street, where the property's main driveway is now.
Mason Klein Smith, a board member, moved to approve the special exceptions for the existing and proposed structures in the locations shown in the record. Jay Featherston seconded the motion. The board called for those in favor to say "aye," recorded no opposition and passed the item.
The approval is conditioned on platting the property before any building permits are submitted and before the special exception is recorded; planning staff also noted the requirement for a post-foundation location survey. The board did not receive public comment on the item during the hearing.
The board then moved to future business for the March 16 meeting and adjourned at 03:43.
