Board of Adjustments approves special exceptions for two residential replats with conditions

The Board of Adjustments approved two special exceptions tied to residential replats Wednesday, requiring that a carport installed without a permit be permitted and inspected before recording and that two nonconforming rear sheds be removed before the plat for a separate property is filed.
Chairman Duncan opened the meeting at 03:50 and presided over the votes. Lisa, a city staff member, presented the staff reports and recommended approval of both special exceptions with conditions. "The requested encroachment is for that front porch on that structure at 7.9 feet and...the requested encroachment [for the carport] is 0.8 feet," Lisa said, and she told the board the carport was installed without a permit.
The first approval concerned BOA25-0010801 at South Trenchard Street. Staff told the board the replat will designate Collins Street as a side yard and Trenchard as the front yard, creating front-yard setback issues for an existing porch and carport; staff recommended approval contingent on obtaining permits and passing inspections for the carport before the special exception is recorded. "Part of that condition is for them to apply for a permit for that carport," Lisa said.
Chairman Duncan opened the public hearing; no members of the public spoke. A motion to approve the special exception with staff conditions was made (the record shows a motion from Danny and a second from Mason) and the board approved by voice vote.
The second approval, BOA25-0011 for 603 North Lane Street, covers an existing duplex that staff said has been in place since at least 1995 and requests a 9.8-foot encroachment into the 25-foot front-yard setback. Lisa told the board that two nonconforming sheds in the rear — one of which extends over the property line — must be removed before the plat is recorded. "They have indicated that they will remove them," Lisa said, but staff said removal had not yet been confirmed; the board therefore made removal of the two nonconforming sheds a condition of approval.
A board member asked for clarity on setback distances if accessory structures are relocated; staff responded that side setbacks would be three feet and rear setbacks 10 feet under the code. The motion to approve BOA25-0011 with the condition that the sheds be removed before the plat is recorded passed on a voice vote (a motion from Buster with a second from Mason is recorded in the minutes).
The board also approved its 2026 meeting schedule, noting two Wednesday meetings due to holidays and that the next meeting is set for Wednesday, Jan. 21, with one pending application. The meeting adjourned at 04:05.
