Board dismisses several complaints as untimely, forwards BEA complaint to outside investigator

The Bandon School District board reviewed a packed complaints docket and, following counsel recommendations, dismissed several complaints as untimely under board policy KL while referring one complaint for further investigation.

Counsel summarized that complaints from Karina Taylor, Amanda Looney, and Chris Trevassol contained allegations that dated outside the KL policy time limits and therefore "do not appear to be timely," prompting motions to dismiss that the board approved. The board chair noted counsel had recommended which complaints should proceed and which should be dismissed.

The board then voted to forward a complaint filed by Jen Els for the Bandon Education Association to an independent investigator (the board referenced engaging Keith Ussery for third-party review). "The portion of the complaint should be permitted to proceed," the chair said when asking for a motion to refer the matter to the investigator; the motion to forward that complaint passed.

Public commenters repeatedly urged the board to follow earlier votes to hire an investigator and to consider placing the superintendent on administrative leave while investigations proceed; the board did not place the superintendent on leave during the meeting. Several board members emphasized their reliance on counsel to evaluate timeliness under policy KL.

The board recorded its motions and will provide the investigator with the complaints counsel recommended for further review. Several dismissed complaints were described in the record as referencing events from 2019—to 2023 and therefore outside the two-year window in policy KL unless the investigator establishes recently discovered evidence.
