Committee moves to accept multiple subdivision roads into county maintenance and begins abandonment of old Nelly Road

The College Transportation Committee in Oconee County voted in March to forward several road-acceptance requests to county council and to begin the legal process to abandon an older gravel section of Nelly Road.

Presenter said the developer realigned a section of Nelly Road to serve a new 58‑lot subdivision and asked the county to accept the newly aligned portions of Nelly Road and Nelly Creek Road into county maintenance. The presenter described engineering issues at the realignment — including a low sag (a K‑value concern) that will require raising that section to meet county standards — and said acceptance should be conditioned on an executed right of way, payment of inspection fees and a warranty bond (three years or 70 percent build‑out, whichever comes first). "Nelly Road is an old road," the Presenter said, and the developer "is looking for the county to accept that portion." The committee approved a motion to accept the realigned sections and a separate motion to begin the abandonment process for the old gravel portion; both actions passed on voice votes with committee members responding "Aye." The presenter explained that the abandonment process requires public notice and, ultimately, a circuit‑court determination before the road can be legally closed.

On Spring Hollow Drive, the Presenter reported the portion from Knox Road to the cul‑de‑sac meets county standards and that the subdivision is substantially built out; because the development is already roughly three‑quarters complete, the presenter said a warranty bond would not be required for that acceptance. The Chair moved and a committee member seconded a motion to forward Spring Hollow Drive to full council for acceptance into county maintenance pending executed right of way and inspection fees; the motion passed on a voice vote.

The committee also considered three roads in a newer subdivision off Wells Highway — Station Road (P‑4353), Utica Bend (P‑404354) and King's Grant (P‑4355). The Presenter said as‑builts show the roads meet construction and alignment standards and that about 70 to 90 percent of houses are built in the subdivision. The Chair moved to forward acceptance of the three roads to county council subject to the same conditions; the motion was seconded and approved by voice vote.

The committee asked the Presenter to supply clearer and more recent aerial imagery and maps at a future meeting. The committee adjourned after the actions were approved.

Next steps: accepted roads will go to the full county council for final action; abandonment of the old gravel portion of Nelly Road will proceed with public notice and, if contested, a circuit‑court process that determines legal abandonment.
