Commission grants Onyx Theater a one‑year extension on its conditional use permit

The commission voted to grant an extension of time to the Onyx Theater's site plan, conditional use permit and architectural review approval. Staff explained permits expire after two years if not acted on; the code allows the commission to grant one‑year extensions, renewable up to five times.

Staff noted the applicants requested more time due to budget and design adjustments but said there had not been substantial changes to circumstances or ordinances that would require re‑review. Applicant representative Andrew confirmed project drawings are roughly 95% complete and the team needs additional time to finalize construction decisions.

The commission discussed options and then moved to approve the extension with the finding that a new public hearing was not necessary because the project and public attitudes have not substantially changed since the initial approvals. The motion passed unanimously on roll call.

Planning staff noted a liaison meeting will address minor sign modifications next week, and that the council will review the item at a future meeting for final action where required.

The extension preserves the applicant's ability to continue design and funding work without restarting entitlement review.
