The Vermillion County Area Plan Commission on March 12 adopted amended rules of procedure that add explicit recusal language requiring members with known conflicts of interest to declare the conflict and excuse themselves from discussion.
During debate, commissioners discussed whether a member should simply recuse from voting or also leave the meeting room during discussion. One commissioner proposed text that a "member shall declare his or her known conflict of interest and excuse himself or herself from the duration of the discussion." Supporters said leaving the room avoids the appearance of influence; others noted court precedent where mere neighborhood opposition did not, by itself, create a disqualifying financial conflict.
After clarifying language, a motion to adopt the rules as presented, including the recusal provision, was moved and seconded; the commission approved the motion by voice vote. The commission also noted that the new text will be recorded in the commission’s minutes as the formal policy on conflicts.
The change updates article 5, section 4 of the commission’s rules of procedure; staff will publish the corrected text with the meeting minutes and apply the language to future hearings.
