Justin Souder, associate planner, told the commission the applicant seeks approval to divide two parcels into 53 lots and that East Green Acres Irrigation District has provided a will‑serve letter for domestic water. Souder said sewer service would be available through the city and that impact fees and a project construction improvement agreement would cover off‑site mitigation.
The developer has agreed as part of the annexation to “fully reconstruct Echo Drive to the Post Falls Highways Highway District standards” from Maguire Road to Corbin Road and to complete a missing sidewalk segment on the east side of Maguire between Saltise and Okanagan, Souder said.
Jeremy Terzulli, the land‑use consultant representing Eagle Crest Land LLC and Olsen Engineering, described geotechnical borings and said the consultant team recommended a 2‑inch overlay as an appropriate alternative pending Post Falls Highway District review. “We have been coordinating with Post Falls Highway District,” Terzulli said, and he added the district is reviewing the recommendation and would be integral to the development agreement.
Commissioners asked whether conditions in the staff report explicitly referenced Echo Drive; staff said they would coordinate with engineering to confirm the correct wording. The motion to approve, moved and seconded during deliberations, adopted conditions 1–7 and 10–11 from the staff report and directed staff to prepare a written reasoned decision.
Roll call recorded affirmative votes from the commissioners present and the motion passed.
The approval requires the developer to complete agreed roadway and sidewalk improvements and to meet code requirements for lot sizes and setbacks. Staff noted administrative exceptions could reduce a 20‑foot rear‑yard setback to 16 feet under current code; a 10‑foot setback would require a PUD or a code amendment. The developer also said many lots are planned as twin‑home parcels with the option for accessory shop structures on some lots.
The commission’s decision will be memorialized in a written reasoned decision and the development agreement with the Post Falls Highway District will need to be finalized before infrastructure assumption.
