Warrick County drainage board allows Bluegrass Creek gas-line work to proceed pending hold-harmless

The Warrick County Drainage Board voted to allow limited progress on a proposed gas-line crossing at Bluegrass Creek, contingent on execution of a hold-harmless agreement covering that crossing.
The project supervisor told the board the contractor would “stay on the southern side” and bore under Gander Road to avoid disturbing the nearby waterway, aiming for a minimum of 5 feet of cover and saying, “We usually push that 10 foot mark.” The work will cross the first culvert only, the surveyor confirmed after showing commissioners a map with two culverts.
Board members pressed for separate permitting steps. One board member said the two crossings (Bluegrass and the Stubb/Stobbs crossing) “need a separate crossing separate application for each separate crossing” and that the county requires a separate hold-harmless for each crossing. The applicant’s engineer had placed one application on file; the board agreed to treat the on-file application as applicable to the Bluegrass crossing and requested a second application for the Stubb(s)/Stobbs crossing be submitted to Ashley.
The board also discussed safety markers and signage: members requested bright yellow posts and conspicuous marking on both sides of the creek so maintenance crews do not accidentally strike the line. The surveyor asked for the project supervisor’s contact information to keep on file for county inspections.
The Chair moved to allow “progress only pending hold harmless.” The motion carried, with the Chair announcing the motion carried 2–0.
The board’s decision allows limited construction activity at the Bluegrass location while requiring the applicant to provide the county’s hold-harmless agreement and to submit a separate application for the other crossing before that work proceeds.
