Oakland Park commission denies local pool-fencing text amendment; staff says state law already governs safety

The Oakland Park City Commission voted unanimously Jan. 14 to deny a proposed text amendment to the city's Land Development Code that would have added local pool-fencing standards.

Assistant City Manager Sierra Marrero told the commission staff had reviewed CD23-32T for a second reading and concluded the state's Residential Swimming Pool Safety Act and the Florida Building Code already define locking mechanisms, self-closing devices, fence height and other safety requirements. "We do not believe that it would be a good idea to incorporate that into the land development code itself as it could create an unnecessary overlap and potential inconsistencies," Marrero said.

Commissioner Budhoo moved to deny the amendment on second reading; the motion was seconded and carried on a roll-call vote with all commissioners voting yes. During discussion, staff and commissioners clarified the city could not retroactively apply new standards to existing pools; new rules would apply only when a building permit is submitted.

The vote ends the local effort to codify additional pool-fencing requirements in Oakland Park's land-use code, with staff saying enforcement of safety barriers will continue through building-permit processes under state law.

The commission did not identify an effective date for the denial beyond completing the second-reading action; no amendments were adopted. The commission moved on to other agenda items following the vote.
