The City Council approved a resolution confirming outdoor-dining permissions for Chop City Grill at 837 5th Avenue South and authorizing a minor change to the private-property configuration: one additional table and additional chairs on private property (pet. 25-OD-19).
The petitioner's agent, Miss Pasadomo, said the fire marshal had approved the life-safety plan and that a Design Review Board (DRB) review was scheduled for 12/19/2025. Planning staff (Tashima Lewis) confirmed the life-safety plan dated 11/18/2025 was approved by the fire marshal, that the petition met code requirements for the 5th Avenue South Special Overlay District, and recommended conditions limiting the area and requiring life-safety conformance and future council review for any expansion.
"Your fire marshal has approved its location from a life-safety perspective," Miss Pasadomo said. During council questions, members confirmed the public-property configuration remains unchanged (7 tables, 18 chairs) and that the only requested changes were to private-property tables/chairs. Councilmember Kramer moved to approve the resolution with the conditions recommended by staff; the council passed the motion unanimously.
The resolution limits the outdoor-dining area on public property to 7 tables and 18 chairs and attaches life-safety and pedestrian-clearance conditions for both public and private portions of the dining plan. The DRB review will proceed per code.
