Committee approves assessment settlements, authorizes property LOI and declines mediation offers

Wauwatosa’s Financial Affairs Committee on March 17 approved several legal and settlement actions after a short closed‑session sequence.
Staff recommended settlements for two excessive assessment claims under Wisconsin statute 74.37: a residential owner at 8217 Brookside Place and Lowe’s Home Centers Inc. at 12000 W. Burley St. Staff said the residential settlement would reduce the assessed value by $203,700 and produce a refund of $3,625.65; the Lowe’s reduction would be about $4.1 million with a refund of $74,191.38. Staff explained that other taxing jurisdictions typically repay about 70% of such refunds, leaving roughly 30% as the city’s fiscal impact (to come from contingency funds). The committee approved the settlements 7–0.
Later the committee moved into closed session under Wisconsin Statutes 19.85(1)(e) and (g) to discuss a negotiated letter of intent for a property purchase inside Tax Increment District 7 and pending litigation matters. After returning to open session, the committee authorized staff to execute the letter of intent and proceed toward purchase and sale terms consistent with the LOI; that motion passed 5–2.
On counsel’s recommendation, the committee also voted to decline a court‑ordered mediation settlement offer related to Milwaukee County case no. 22‑CV‑4819 and approved the settlement in the Patricia Love litigation; both votes were recorded in open session and passed by committee vote (decline motion and Love settlement each recorded as passing 7–0). The city attorney and outside counsel indicated packet materials include the settlement specifics for public review.
