Summary
The Black Hawk County Board of Supervisors adopted ordinance 77-305 March 10 to rezone a 2.45-acre parcel at 301 West Marquis Road for residential use to allow an estate-planning split; the planning commission had recommended unanimous approval, and the applicant testified she intends to keep farm acreage with a tenant.
The Black Hawk County Board of Supervisors voted March 10 to adopt ordinance number 77-305, rezoning a 2.45-acre parcel at 301 West Marquis Road from agricultural to residential to permit an estate-planning split.
Planning staff Joseph Galman told the board the house has been on the property for about 15 years, making it eligible for rezoning and subdivision; he said a small corner of the parcel lies in the floodplain but that it does not preclude approval and noted the planning and zoning commission recommended unanimous approval.
The applicant, Rachel Zapadot, told the board she inherited the property from her father and now occupies the house full time with her husband. "My request is simply for estate-planning purposes," Zapadot said, adding that a tenant farmer will continue to farm a portion of the southeast corner.
The board waived the required two-meeting notice under its rules, closed the hearing after accepting oral and written comments, and carried the adoption on a recorded roll call.
Why it matters: The change allows the homeowner to separate the house from the larger farm tract for estate-planning while leaving the farming operations intact. The ordinance becomes part of the county's agricultural-preservation zoning code and will be recorded per county procedure.
What’s next: The county clerk will file the adopted ordinance and publish it in accordance with state code. No appeals or additional permits were recorded during the hearing.
