Senators debate S.206 tweak to ease licensing for home child-care centers and committee jurisdiction

Senate Education Committee members debated a proposed amendment to S.206 that, according to the chair, would let someone open a home child-care center with a level-1 certification and then gain higher certification over time.

"I basically wanna tweak a little bit... allows somebody to open a home center with just the level 1 certification," the committee chair said, describing an intent to make it easier for providers to begin operating and then meet stronger standards over a period of years.

Members raised concerns about fire-safety and state licensure rules. One committee member noted that some home providers closed after higher regulatory requirements were imposed, and another warned that relaxing fire-safety rules "would be in very big trouble." Speakers also queried whether public pre-K programs would be exempt from the bill’s licensing rules or whether any entity that receives public dollars would fall under the same standards.

Committee members said jurisdictional questions remain. One member noted that the bill had been on the floor and that the committee that originally received the bill might be different from the committee drafting the childcare changes. Others suggested a "drive-by" review from Education for courtesy when a bill touches the committee's subject matter.

No final jurisdictional decision or amendment vote was recorded during the session; the discussion closed with senators acknowledging the complexity of licensing, public-funding thresholds and safety rules and agreeing to further consideration.
