Planning Director Schultz told commissioners the 8,800-square-foot home sits on a three-acre parcel and that staff recommended approval "subject to the three findings at the end of the staff report." Schultz stated, "In our opinion, the applicant has met their burden of proof and has demonstrated that all applicable criteria of the village code has been met." He cited Village of Los Ranchos code section 9-2-25 as the applicable standard.
Applicant Larry Chavez said the home contains two well-separated suites so he and his wife can maintain private living quarters while hosting guests. "My primary motivation for this is I'm very involved with the University of New Mexico Athletic Department and I've invited them to utilize my home for recruiting," Chavez said, adding the property will also occasionally be available to the general public.
Commissioners asked about on-site operation, occupancy and rules. Commissioner Baldwin pressed whether the owner or an operator would be on site; Chavez said, "Either myself or my wife," and usually both will be present. A commissioner asked how many recruits typically visit; Chavez said generally one, occasionally two, and parents may accompany recruits. Commissioner Edward asked about an on-site rules book and how taxes are collected when rentals are handled privately versus by platforms; Director Schultz said operators must obtain a village business license, provide a CRS number, and staff will ensure tax codes are applied.
The commission moved to approve ST 2501 with a friendly amendment to incorporate the three staff findings listed in the director's report; the amendment was accepted by the motion maker and seconder. In a roll call vote the commission recorded unanimous "yes" votes and the commission "let the record show that this has been approved" and closed the case.
The approval is a final administrative decision for this docketed short-term rental application; staff indicated there were no written comments in support or opposition in the packet. The commission then returned to the regular agenda and adjourned the meeting.
