Staff backs reduced-intensity commercial zoning on Rogers Road after earlier warehouse proposal drew opposition

Gina Costanza Grant, planning staff, told the commission the applicants revised earlier requests and now propose a regional commercial future land use for the east parcel on North Rogers Road and a CC (community commercial) rezoning for parcels on both sides of the road. "We did re-notify the case," Grant said, and while earlier proposals drew a petition and at least one neighborhood opposition letter, the revised request had not produced new comments by the time of the work session.
Key details: staff emphasized that the revised zoning removes the manufacturing/warehouse-heavy M L 20 classification and instead allows CC uses with specific limits: indoor storage is allowed but must not exceed 49% of lease space; outdoor accessory storage is permitted but limited and must be screened by a 7-foot blind fence, with stacked materials kept at least one foot below fence height; automotive display outdoors is limited to 10 vehicles.
Council and operational implications: staff explained that the West side parcel previously tied parking to the East side for an entertainment use (Southern Junction) and that separating the parcels means each must stand alone for parking compliance. "They can continue to operate the Southern Junction as long as they have the East Side," a staff attorney said, noting that losing the East Side parking would leave the business nonconforming.
Public notice and next steps: Grant said staff will accept and forward any comments that arrive after P&Z to City Council for consideration. Because staff recommends approval of the revised CC classification and added use limits, the matter will move forward to public hearings in front of council unless substantive new opposition emerges.
