Chelsea Lieverson, planning staff, presented Simonson Company's Fifth Edition, a minor replat for a 38th Street South property zoned LC (limited commercial) with an existing conditional overlay; the plat relocates an established utility easement and does not change zoning. Staff confirmed vehicle access will use an existing right‑in/right‑out on 38th Street. The commission approved the plat per staff recommendation.

Staff said it had received two inquiries, including one from a neighbor who raised concerns about potential noise and odors; staff recommended conditions to address industrial uses in the zone, including an additional landscape buffer to screen possible nuisances. The commission approved the CUP per staff recommendation. Staff reminded the commission that appeals of planning commission decisions under the LDC may be filed with the city commission within 10 days.
Megan Elsaug presented the final plans for the J & O 45th Street Apartments PUD, covering four easterly buildings in the PUD’s next phase. She said the final plans were consistent with the previously approved PUD master plan and ordinance and noted that building permits and other city reviews remain required. Commissioners asked whether cul‑de‑sacs and related infrastructure would be in place before occupancy; staff said the cul‑de‑sacs were dedicated as right‑of‑way in the earlier plat and are part of a developer’s agreement, and the developer had waived the right to protest improvements so construction by the city can proceed. Brian Pattengale of Houston Engineering said design coordination with city engineering is underway, construction is expected this year, and building occupancy likely in early spring of next year following a 12–18 month construction period. The commission approved the final plan by roll call.
The meeting opened with an announcement about an LDC workshop on Thursday, April 9, from 12 p.m. to 1:30 p.m. at Sky Commons on the second floor of the Civic Center; the workshop will present a project update, preview an April discussion draft, and include a presentation followed by breakout sessions.
